Product: OPSpectra Lite
Effective date: 2026-09-10
Document revision: 2026-09-10.1

1. Licensor, transaction seller and acceptance

The Product's licensor, developer and technical supplier is ITPartner Paweł Gejda, trading as ITPartner PG, address: 32-700 Bochnia, ul. Podedworze 27G/6, Polska, Polish tax ID: 739-370-30-66, EU VAT ID: PL7393703066, support email: support@opspectra.com (the “Licensor”).

The seller responsible for a transaction is the entity identified at checkout, in the order confirmation or purchase document. For purchases through Lemon Squeezy, Sold through Link, LLC f/k/a Lemon Squeezy LLC (Lemon Squeezy) acts as Merchant of Record. This EULA governs the Product license regardless of the lawful sales channel; payment, tax and refund terms can depend on the transaction seller.

This EULA should be made available to the buyer before purchase through the product page, offer description or a stated terms link, and a copy is also included with the Product. Use of the Product is subject to this license. If the User does not accept the EULA, the User must not use the Product and should exercise any rights available from the transaction seller. This does not limit mandatory consumer rights or any legal requirement for effective pre-contract disclosure of terms.

2. License grant

Following a valid purchase, the Licensor grants a non-exclusive, non-transferable and non-sublicensable license:

  1. to one named user;
  2. within one legal entity, organization or sole proprietorship that purchased the Product;
  3. solely for internal assessment of Microsoft Azure environments owned by that organization or managed for its own internal operations;
  4. to use the properly purchased and downloaded version perpetually;
  5. on devices used by the licensed user and for a reasonable number of backup copies.

Lite processes one selected tenant context and one subscription per run. Any number of internal runs is permitted.

3. Reports

Reports may be used inside the licensed organization and shared with its auditors, legal or professional advisers bound by confidentiality. The User retains rights in its Azure data and output. Sharing output must not expose the Product or source files to unauthorized persons.

4. Updates

Early Access includes OPSpectra Lite updates made available by the Licensor up to and including version 1.0, without a commitment to a feature or release date. Pro, post-1.0 releases, other editions and services can carry separate fees. The perpetual right to a validly downloaded version remains unless this EULA is breached.

5. Restrictions

Without a separate written license, the User must not share the package/source/documentation outside the licensed organization; resell, redistribute, sublicense, rent or publish it; allow multiple users or organizations; perform paid third-party audits, reports or consulting; use it in client environments as an MSP/MSSP/outsourcer/consultant; circumvent licensing limits or remove legal notices; or scan an environment without authority. Mandatory rights that cannot lawfully be restricted remain unaffected.

6. Intellectual property

Code, Findings rules, documentation, report design and the brand remain the Licensor's or applicable licensors' property. Microsoft, Azure and PowerShell marks belong to their owners. The Product is independent and is not sponsored, endorsed or supported by Microsoft.

7. Security and User responsibility

The Product runs locally and is designed for read/query operations. The User is responsible for the correct account and scope, authorization to scan, securing the Product and output directory, and independent verification before operational decisions. Output can contain confidential identifiers, RBAC, tags, costs and recovery data.

8. Support

Self-service support covers package integrity, documented startup, reproducible defects, report fields and read permissions. It excludes consulting, remediation, backup/DR design or recovery testing, FinOps, RBAC redesign and custom development. Contact: support@opspectra.com.

9. Early Access, nature of results and liability

The Product can contain errors or limitations depending on permissions, Az modules, Azure APIs and configuration. It is not an audit, SIEM, certification, backup product, recovery test or guarantee of backup, DR, availability or complete cost data. Unknown, Unavailable and Not assessed are not positive results. A detected restore point is technical evidence, not proof of a healthy active backup policy.

To the extent permitted by law, the Licensor is not liable for indirect loss, lost profit or data loss arising from decisions without independent verification; aggregate contractual liability is limited to the price paid. This does not exclude liability that cannot lawfully be excluded or mandatory consumer rights.

10. Termination and law

The license can terminate for material breach. The User must stop use and delete Product copies; prior reports can be retained as required by law and organizational policy.

Polish law governs. A consumer retains mandatory protection of the country of habitual residence and applicable consumer jurisdiction. Nothing limits mandatory digital-content conformity rights.

1. Roles

The developer, Licensor and technical supplier is ITPartner Paweł Gejda, trading as ITPartner PG, address: 32-700 Bochnia, ul. Podedworze 27G/6, Polska, Polish tax ID: 739-370-30-66, EU VAT ID: PL7393703066. Product support: support@opspectra.com.

For purchases through Lemon Squeezy, Sold through Link, LLC f/k/a Lemon Squeezy LLC (Lemon Squeezy) is the transaction seller and Merchant of Record. Lemon Squeezy collects payment, determines and collects applicable transaction taxes, issues purchase documents, and handles payments, refunds and chargebacks under its Buyer Terms and applicable law. The Licensor provides the license, documentation and technical support.

This notice is for the Lemon Squeezy channel. Direct sales or another marketplace require a separate channel notice identifying the seller, checkout, consumer contact, refunds and taxes; this file must not be published as direct-sales terms.

2. Main features and compatibility

OPSpectra Lite is a downloadable PowerShell package for local, read-oriented collection from one selected Microsoft Azure tenant context and one subscription per run. It generates an HTML report, CSV files, Findings and a log. Scope includes current resources, RG/RBAC context, tags, selected service state, Cost Management, dedicated recovery checks and separate restorePointCollections evidence.

Windows and macOS are supported and product-tested. Linux support has preview status. PowerShell 7, applicable Microsoft Az modules, a browser and Azure endpoint access are required. Visibility depends on permissions and external-service responses. See docs/EN/REQUIREMENTS.md.

3. Price and order

The price, currency, taxes, any promotion and final amount are displayed at checkout and in the order confirmation. Product documents do not set a fixed price. Pricing can vary between offers, markets, channels or tests subject to law and platform rules; a later change does not alter a license already validly acquired.

4. Delivery, license and updates

The Product is delivered electronically as a ZIP after successful purchase. The complete package must be extracted. legal/EN/EULA.md defines the license. Early Access includes Lite updates made available through version 1.0 without a guaranteed schedule or feature.

5. Product conformity and report limitations

Mandatory consumer rights remain unaffected. The report is supporting information and does not replace an audit, monitoring, Microsoft documentation, a recovery test or a specialist. Missing data caused by permissions, Azure API availability or configuration is not automatically a Product defect, but a reproducible Product defect can be reported.

See legal/EN/REFUNDS-COMPLAINTS.md for this channel's withdrawal, refund and complaint information.

3. RequirementsOpen

Effective date: 2026-09-10

Supported platforms

  • Windows: supported and product-tested;
  • macOS: supported and product-tested;
  • Linux: technically expected to work, but support remains in preview until product acceptance testing is completed.

PowerShell 7 or newer (pwsh), a current Edge, Chrome, Firefox or Safari browser, and network access to Microsoft Azure authentication and management endpoints are required.

Microsoft Az and preflight

Before sign-in, the product checks the operating system, PowerShell version and required Az commands. It never installs software automatically. Missing core commands stop execution with an actionable installation message. Missing optional commands produce a warning and can reduce backup/recovery enrichment to Unknown or Unavailable.

Recommended installation from PowerShell 7:

Install-Module Az -Scope CurrentUser -Repository PSGallery -Force

After installation, close PowerShell, start pwsh again and rerun the product.

Azure permissions

The signed-in identity must be able to read the selected subscription. Optional enrichment can require additional read access to Cost Management, Resource Group role assignments, Recovery Services/Backup, Microsoft.Compute/restorePointCollections and their restore points (including instanceView), Azure SQL retention policies and App Service backup/snapshot data.

Missing optional visibility must degrade to Unknown, Unavailable, Not assessed, a partial state or a log message — never to a synthetic positive result.

OPSpectra Lite does not require its own service principal, app registration, web server, database, OPSpectra account, Node.js, IIS or Docker.

4. Refunds & ComplaintsOpen

Effective date: 2026-09-10
Document revision: 2026-09-10.1

1. Transaction seller

For orders placed through Lemon Squeezy, Sold through Link, LLC f/k/a Lemon Squeezy LLC (Lemon Squeezy) is the seller and Merchant of Record. Questions about charges, invoices/receipts, transaction tax, payment refunds or chargebacks must follow Lemon Squeezy's Buyer Terms and support channels. The Licensor handles technical Product complaints at support@opspectra.com and cooperates where the transaction seller must act.

2. Withdrawal for digital content

The Product is paid digital content not supplied on a tangible medium. A statutory withdrawal right can be lost only when all requirements of applicable law are met, including the consumer's prior express consent to begin supply, acknowledgment of the resulting loss of the right, and confirmation of the contract on a durable medium. The checkout/transaction seller is responsible for obtaining and confirming those steps.

If the requirements are not met, statutory rights remain. Platform policy and the EULA do not restrict them.

3. Digital-content conformity complaint

Report reproducible Product issues to support@opspectra.com with the version, operating system, PowerShell, detected Az modules, exact error and reproduction steps, plus only the minimum redacted log lines. Do not send tokens, passwords or a full report.

Consumers retain mandatory digital-content remedies, including bringing content into conformity and, where statutory conditions apply, price reduction or termination/withdrawal. Complaints are handled without undue delay and within any mandatory response deadline.

4. Environment limitations

Missing data caused by insufficient permissions, a missing optional Az module, Azure API availability, service configuration or subscription limitations is not necessarily Product non-conformity. Support will help distinguish a reproducible Product defect from an environment limitation. Mandatory rights remain unaffected.

5. Product PrivacyOpen

Effective date: 2026-09-10
Document revision: 2026-09-10.1

1. Controller and scope

The controller for data received directly for licensing and technical support is ITPartner Paweł Gejda, trading as ITPartner PG, address: 32-700 Bochnia, ul. Podedworze 27G/6, Polska, email: support@opspectra.com.

Checkout, payment, transaction-tax, purchase-document and refund data is processed by Sold through Link, LLC f/k/a Lemon Squeezy LLC (Lemon Squeezy) under its own terms, privacy notice and the role applicable to the relevant processing activity. To the extent Lemon Squeezy acts as Merchant of Record and processes data for its own transaction or legal purposes, it acts independently from the Licensor. This notice does not replace Lemon Squeezy's privacy notice or the Licensor's website privacy/cookie notice.

2. Local Product model

The Product requires no OPSpectra account/backend and contains no telemetry sending scan results to the Licensor. Authentication uses Microsoft Azure / Microsoft Az. Reports and CSV files can contain tenant/subscription identifiers, Resource IDs, RBAC, tags, costs and recovery data; they remain local unless the User shares them.

3. Data, purposes and legal bases

The controller can receive:

  • order/license data made available by the platform, such as email, order ID, Product and status, to perform the license/contract, provide support and prevent abuse — GDPR Article 6(1)(b) and (f), and (c) where legally required;
  • contact data, request content, Product/runtime information and voluntarily provided redacted logs, to support and perform the contract — Article 6(1)(b);
  • data required for legal duties and claims — Article 6(1)(c) and (f).

Providing data is voluntary but support or license administration may be impossible without the minimum required information. Do not submit scan data beyond what is necessary.

4. Recipients, transfers and retention

Data can be processed by email, hosting, security and support providers, and exchanged with the sales platform where relevant. If a provider processes data outside the EEA, transfer relies on the provider's applicable lawful mechanism, such as an adequacy decision or standard contractual clauses.

Support data is retained for handling and then as required for claims; legally required records are retained for statutory periods. Unnecessary data is deleted or anonymized under data-minimization principles.

5. Rights

Depending on the legal basis, a person can request access, correction, erasure, restriction, objection and portability, and lodge a complaint with the Polish data protection authority (UODO). Contact: support@opspectra.com. Any consent can be withdrawn without affecting prior lawful processing.

The controller does not make decisions producing legal effects solely through automated processing of support data.

6. Website and other channels

Forms, newsletter, analytics, cookies or direct sales require a separate current website notice and, where applicable, cookie consent controls. Another platform requires updating controller/recipient and data-flow information.
